recently an unstarred question on rajya sabha(no2049) was posed by Smt
Brinda Karat,and sri jai prakash agrawal and was replied by Dr.anbumani Rama
Doss on 7-12-07,cp-124.
Question:
will the ministerof MOHFW be pleased to state
a)Whether it is a fact that drugs discarded globally are available in Indian Market.
b)If so, Brand Names of Drugs those are globally discarded. and
c)the action being taken by government against the pharmaceutical companies
and marketing those drugs in the country?
Answer
a) No,sir.There is no such term called globally discarded
drugs.Therationality, safety and efficacy of a drug is asertained based
on risk benefit analysis as per provisons scheduleY of Drugs and Cosmetics rules before market approval in the country.There is regulatory system in place for ensuring safety and efficacy of marketed drugs in the country.
The drugs and cosmetics act 1940 was amended in 1982 to empower central
government to prohibit manufacture and sale of Drugs that are considered
harmful or not rational, through notification under section 26a of drugs and cosmetics act.So far 76 categories of drug formulations have been prohibited in the country.
I request all members to debate this question and answer.
What is status of regulatory system in the country.
I met parlimentary commitee members on Jan13th and Mr.Amar Singh leader of the commitee requested for a document for comprehensive changes needed in D&C act.
I shall be grateful if any member can provide information on current status
of Chennai high court case and list of FDC banned by DCGI.
