La ddI est un médicament antiretroviral qui est utilisé en association avec
d?autres pour soigner les personnes porteuses du HIV.
La recherche pour la ddI a été réalisée en 1989 par l?Institut National de
la Santé (NIH) financé par le gouvernement US. Le comprimé original de ddI
doit être pris avec un tampon antiacide pour réduire l?acidité dans l?
estomac qui, sinon, diminuerait l?action de la ddI.
Le NIH a donné le droit de commercialisation des comprimés de ddI à
Bristol-Myers Squibb Company Limited (BMS) pour les vendre dans 8 pays
développés. Une fois que BMS a eu reçu la licence de commercialisation, ils
ont développé une formule de ddi dans laquelle la ddI et le tampon antiacide
sont réunis dans le même comprimé, une technique déjà bien connue parmi les
pharmaciens.
En 1998 BMS a présenté une demande et obtenu un brevet Thaï (numéro 7600)
pour une association de ddI et d?autres substances (un antiacide qui aide à
une meilleure absorption de la ddI par l?estomac) du Département Thaï de
Propriété Intellectuelle (DIP). Il y a actuellement 2 perpectives  pour ce
brevet BMS.

1ere affaire ? Des problèmes dans l?enregistrement du brevet Thaï conduit à
la délivrance d?un brevet non valide.
Les points essentiels du jugement stipulent :
&# 61623 ; les personnes vivant avec le Sida et les ONG Thaï travaillant sur
le Sida peuvent être considérées comme parties concernées dans un conflit
par rapport au brevet.
&# 61623 ;BMS avait corrigé leur demande de brevet 3 ans après sa soumission
dans le but de réclamer un monopole plus étendu que celui justifié par la
description du brevet.
« Le cour a décidé (le 1er octobre 2002) que cet amendement était illégal et
a signifié à BMS de revenir à la demande originale »

2ème affaire? Le Réseau pour les Personnes vivant avec le Sida, les ONG
travaillant sur le Sida, la Fondation pour le Consommateur et un certain
nombre d?experts pharmaceutiques ont examiné le brevet BMS n° 7600 et trouvé
qu?un tel brevet ne présente pas une avancée inventive ou novatrice
significative, critère nécessaire à appliquer pour octroyer un brevet. Donc
le brevet Thaï sur les comprimés ddi n°7600 n?aurait pas du être accordé. En
conséquence, une seconde affaire est présentée à la cour de Commerce
Internationale et de Propriété
Intellectuelle Centrale (CIPITC) par la Fondation pour le Consommateur et un
groupe de personnes porteuses du Sida, aujourd?hui 9 octobre 2002 à 10 pm,
dans laquelle ils vont demander que le brevet BMS pour les comprimés ddi
soit abrogé.

ddI is an antiretroviral drug which is used in combination with others to
treat people
infected with HIV.  The research for ddI was carried out by the US
government
funded National Institute of Health (NIH) in 1989. The originally tablet of
ddI had to
be taken with an antacid/buffer to reduce acidity in the stomach which would
otherwise reduce the action of ddI.  The NIH licensed the marketing right of
 ddI
tablets to Bristol-Myers Squibb Company Limited (BMS) to be sold in 8
developed
countries. Once BMS had been granted the marketing license they developed a
formulation of ddi in which the ddI and buffer were combined in the same
tablet, a
technique already well-known amongst pharmacists.  In 1998 BMS applied for
and
received a Thai patent (number 7600) on a combination of ddI plus other
substances (antacid which help the ddI to be better absorbed from the
stomach)
from Thai Department of Intellectual Property (DIP). There are currently 2
legal
challenges to this BMS patent.

1st case ?  Problems in the Thai patent registration lead to the issuing of
an invalid
patent. Key points in the judgement include:
 People living with HIV/AIDS and a Thai NGO working on AIDS can be
considered as injured parties in a dispute over patent.
 BMS had amended their patent application three years after it was
submitted, in
order to claim a wider monopoly than the patent description justified.
?The court said (on 1st October 2002) this amendment was illegal and
 has ordered BMS to put back the original claim.?

2nd case ? The Network for People living with HIV/AIDS, AIDS NGOs, the
Foundation for Consumer  and a number of pharmaceutical experts have viewed
the BMS patent number 7600 and found that such a patent does not show
significant inventive step or novelty, necessary criteria in application for
and
granting of a patent.  Therefore the Thai patent on ddI tablet number 7600
should
not have been granted. Consequently, a second case is brought to The Central
Intellectual Property and International Trade Court (CIPITC) by The
Foundation for
Consumer and a group of HIIV infected  today, 9th October 2002 at 10 pm. In
which
they will call for the BMS patent for ddI tablets to be revoked.
