Pfizer poursuivi pour avoir bloqué un générique de Diflucan

TRENTON, N.J. - Pfizer Inc. a poursuivi les laboratoires Ranbaxy pour les
empêcher de commercialiser leur générique de Diflucan, un antifongique qui
pèse 1 milliard de US dollars par an.

Ranbaxy, dans sa soumission à la Food and Drug Administration en vue de
commercialiser une version moins chère du Diflucan, a déclaré que le brevet
de ce produit, normalement enregistré, n'est pas valable. Ranbaxy a aussi
nié être en infraction avec le brevet.

Le brevet de Pfizer s'applique au composé chimique du fluconazole, le
principe actif de cet anti-fongique à usage humain et vétérinaire. Pfizer,
dans son action, soutient que le brevet est valable et que Ranbaxy est en
infraction si la FDA approuve le produit de ce laboratoire. Pfizer dit avoir
informe Ranbaxy qu'un juge fédéral a confirmé la validité du brevet.

Ranbaxy pour sa part attend que l'affaire passe au tribunal pour clarifier
la réglementation fédérale sur les enregistrements de génériques.

"On pense que le brevet n'est pas valable" a déclaré Jay Deshmukh, vice
président chargé des questions sur la propriété intellectuelle à Ranbaxy.
"Ils ne sont pas d'accord, donc on ira au tribunal."

Novopharm Ltd., un fabricant de génériques basés en Ontario, Canada, avait
de son côté sollicité l'enregistrement de son fluconazole. Un juge  de
l'Illinois avait reconnu la validité du brevet, et le procès engagé par
Pfizer avait été arrêté à la suite de la reconnaissance par Novopharm que sa
demande venait en infraction du brevet.

Pfizer argumente que Ranbaxy devrait reconsidérer ses propos, à savoir la
non validité du brevet, alors que Ranbaxy maintient sa position.

Pfizer sues to block generic Diflucan

TRENTON, N.J. - Pfizer Inc. sued Ranbaxy Laboratories Ltd. to block the
Indian drug-maker from selling a generic version of the $1 billion-a-year
antifungal treatment Diflucan.

Ranbaxy, in an application to the U.S. Food and Drug Administration to sell
a low-cost version of the drug, said a patent for Diflucan listed on the FDA
registry of approved drugs is invalid. Ranbaxy also denied infringing the
patent.

Pfizer's patent covers the chemical compound for fluconazole, the active
ingredient in the antifungal treatment for animals and humans. The company
said in its suit that the patent is valid and Ranbaxy will infringe it if
the FDA approves the generic product. Pfizer said Ranbaxy has been notified
that a federal judge upheld the patent's validity.

Ranbaxy said it expected the lawsuit because of federal regulations on
generic drug applications.

"We think the patent is invalid," said Jay Deshmukh, vice president in
charge of global intellectual property for Ranbaxy. "They don't agree, so
we're going to go at it in court."

Novopharm Ltd., a generic-drug-maker based in Ontario, previously sought
approval to sell fluconazole. A federal judge in Illinois in February said
the patent was valid, and a suit filed by Pfizer was dismissed following an
agreement that Novopharm had infringed the patent with its FDA application,
according to the suit.

Pfizer's suit said it "suggested that Ranbaxy reconsider its assertion" that
the patent was invalid, though "Ranbaxy maintained its position."
