The issue that Duang has raised is an extremely important and
fundamental one.

In my experience the major hurdle to avoiding such potential
conflicts of interest in developing and middle income countries is to
ensure that state inspectors get paid at least as much as private
sector pharmacists (and usage of appropriate incentives).
Legislation has a place in avoiding conflict of interest situations, but
ultimately you have to look at the motivating factors for retaining
inspectors that possess the desired attributes as clearly spelled out
by WHO and what the state is prepared to pay for providing this
important service. If a pharmacy inspector only gets paid half the
wage of what he can expect to get in the private sector then it is
no surprise to see conflict of interest situations arising and possible
poor quality of inspectors.
